Resilient Florida Program

The Resilient Florida Program is administered by the State of Florida Department of Environmental Protection. Attachment 6 establishes program-specific requirements governing grants under the Resilient Florida Program, including deliverable submission, payment requests, progress reporting, project documentation, intellectual property, geographic information system data, permitting, implementation requirements, and certain requirements applicable to projects funded with American Rescue Plan Act funds. The attachment identifies the Department's Office of Resilience and Coastal Protection Resilient Florida Program as the funding program associated with the required funding-source disclaimer. The document does not state a competitive application opening date, application deadline, award amount, number of awards, or a complete list of eligible applicant types. Grant deliverables and payment requests using Exhibit C must be submitted to ResilientFloridaGrants@FloridaDEP.gov. Grantees must submit the Exhibit A Progress Report Form quarterly beginning with the quarter of the Agreement Execution Date and continuing through the quarter in which the final task deliverable is accepted and the Grantee receives a Deliverable Acceptance Letter. When Contractual Services are included as a grant agreement budget category, Exhibit H, Contractual Services Certification, and its required supporting documentation must be provided for each contractor before the Grantee submits a payment request for contractual services. If Attachment 2 of an individual agreement includes match requirements, the Grantee must submit the Grantee Match Form upon execution and whenever the amount or source of matching funds changes during the agreement period. The program also imposes project documentation and final-report requirements. Exhibit G, Photo Release Form, must accompany the first submission of deliverables and reports that contain photographs. Final Vulnerability Assessment Reports, Adaptation Plan reports or documents, and permanent signage created for implementation projects included on the Statewide Flooding and Sea Level Rise Resilience Plan must display the Department's logo and the prescribed Resilient Florida funding-source disclaimer. Exhibit F, Final Project Report Form, must be submitted before a final payment is requested. For grants using American Rescue Plan Act funds that are not completed by the Agreement's Date of Expiration, Exhibit F must also be submitted upon completion of the project even when completion occurs after the stated expiration date. Grant-supported work is subject to additional technical and legal requirements. The Department reserves a royalty-free, nonexclusive, and irrevocable license to reproduce, publish, use, and authorize others to use for state government purposes copyrighted work developed under the agreement and rights or copyrights acquired with grant support. Copyrighted, patented, or trademarked software or programming purchased or licensed with grant funds must comply with Chapter 119, Florida Statutes, and the Department will not approve payment for software or programming that does not fully comply. GIS files and associated metadata must follow the Resilient Florida Program GIS Data Standards, with raw data sources identified in the associated metadata. Each deliverable is reviewed individually under the applicable grant agreement, including Attachment 3, Grant Work Plan, and the Department may require additional verification when questions arise regarding the accuracy or validity of a deliverable. Implementation grants carry additional conditions. For a state-funded construction project located where a Sea Level Impact Projection study is required under Section 380.0937, Florida Statutes, the Grantee is responsible for conducting the study and submitting the resulting report. The report must be received and approved by the Department and published on the Department's website for at least 30 days before construction begins, and it must satisfy applicable statutory requirements and Chapter 62S-7, Florida Administrative Code. Receipt of a grant does not guarantee issuance of federal, state, or local permits. Grantees must obtain all necessary permits before conducting grant-funded activities subject to permitting requirements, comply with permit terms and conditions, and provide copies of required and approved permits upon request. Grant funds generally may not be used for ongoing efforts to satisfy certain legal or regulatory requirements or for actions that were unanticipated, nonexistent, or unknown to the Department when the agreement was executed. The restriction includes specified regulatory and permit compliance requirements, noncompliance and citation fees, fees resulting from unanticipated permit conditions, settlement agreements, and compliance with formal or informal enforcement actions resolving rule or statutory violations. The program may approve use of grant funds for ongoing permit-required conditions such as pre-construction, construction-period, and post-construction monitoring and mitigation. For ARPA-funded grants, certain match-funded deliverables not accepted before the Agreement's Date of Expiration require submission of Exhibit M, Match Expenditure Monitoring Form, before ARPA-funded grant closeout. The attachment does not establish application evaluation criteria, a solicitation deadline, an award notification schedule, a standard performance period, or a recurring application cycle; those details must be verified from the applicable solicitation and individual grant agreement.
